These Terms of Service govern the use of the ATHLESY platform (website and application), operated by:

2. Scope
These Terms apply to all users of the ATHLESY platform, including the website at athlesy-app.com and any associated applications. By registering an account, you agree to these Terms in their entirety. If you do not agree, you may not use the platform.
3. Description of Services
ATHLESY is a social sports platform that connects people for shared physical activities. The platform provides:
- AI-powered matching with sports partners based on sport, fitness level, location, and availability
- Event creation and discovery
- Direct messaging between users
- Community and social features
ATHLESY does not organize, supervise, or guarantee any physical activities. Participation in any sporting activity arranged through the platform is at the user's own risk and responsibility.
4. Registration and Account
Users must be at least 18 years of age to register. You must provide accurate, complete, and current information during registration and are responsible for keeping your account information up to date.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
ATHLESY reserves the right to refuse registration or terminate accounts at its discretion, particularly in cases of violation of these Terms.
5. User Obligations
By using ATHLESY, you agree to:
- Provide truthful information about yourself, your fitness level, and your sport preferences
- Treat other users with respect and refrain from harassment, threats, or discrimination
- Not use the platform for commercial purposes, spam, or unsolicited advertising
- Not share content that is illegal, offensive, misleading, or infringes on third-party rights
- Not attempt to reverse-engineer, scrape, or otherwise misuse the platform
- Comply with all applicable laws in your jurisdiction
ATHLESY reserves the right to remove content or terminate accounts that violate these obligations without prior notice.
6. Premium Subscription
ATHLESY offers a free basic tier and a paid Premium subscription. Premium pricing starts at EUR 4.99 per month (exact pricing may vary by region and is displayed at checkout).
Premium subscriptions renew automatically each month unless cancelled at least 24 hours before the renewal date. You may cancel your subscription at any time through your account settings. Upon cancellation, Premium access continues until the end of the current billing period.
ATHLESY reserves the right to change Premium pricing with at least 30 days' prior notice. Continued use after the notice period constitutes acceptance of the new pricing.
7. Data Protection
Your use of ATHLESY is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please refer to our Privacy Policy.
8. Intellectual Property
All content on the ATHLESY platform, including the name, logo, design, software, and text, is the intellectual property of ATHLESY UG (haftungsbeschränkt) and is protected by applicable copyright and trademark laws.
You retain ownership of content you post (e.g. profile photos, messages). By posting content, you grant ATHLESY a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content within the platform for the purpose of providing the service.
9. Disclaimer and Limitation of Liability
ATHLESY is provided "as is" without warranties of any kind, express or implied.
ATHLESY does not guarantee the accuracy, completeness, or uninterrupted availability of the platform.
ATHLESY is not responsible for the actions, content, or conduct of any user on or off the platform. Physical activities involve inherent risks. ATHLESY is not liable for any injury, loss, or damage arising from sporting activities arranged through the platform.
To the maximum extent permitted by applicable law, ATHLESY's total liability for any claim is limited to the amount you paid for Premium services in the 12 months preceding the claim, or EUR 100, whichever is greater.
10. Indemnification
You agree to indemnify and hold harmless ATHLESY UG (haftungsbeschränkt), its founders, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the platform or violation of these Terms.
11. Amendments
ATHLESY reserves the right to update these Terms of Service at any time. We will notify registered users of material changes via email or in-app notification at least 14 days before the changes take effect. Continued use of the platform after the effective date constitutes acceptance of the updated Terms.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany. Place of jurisdiction is Düsseldorf, Germany, to the extent permitted by law.
